Dispõe sobre a estrutura administrativa da Casa Militar da Governadoria do Distrito Federal e Altera o Art. 12 do Decreto nº 36.236 de 01 de janeiro de 2015.
O GOVERNADOR DO DISTRITO FEDERAL, no uso das atribuições que lhe conferem o artigo 100, incisos VII, X, XXVI, da Lei Orgânica do Distrito Federal, combinado com o art. 3º, inciso III, da Lei nº 2.299, de 21 de janeiro de 1999, DECRETA:
Art. 1º A Casa Militar da Governadoria do Distrito Federal passa a ter a estrutura administrativa disposta no Anexo I deste Decreto.
Art. 2º As unidades administrativas, os cargos de natureza especial e os cargos em comissão listados no Anexo II ficam transformados nas unidades administrativas, nos cargos de natureza especial e nos cargos em comissão listados no Anexo III.
Parágrafo único. As transformações mencionadas no caput deste artigo são decorrentes de reestruturação e não acarretam aumento de despesas.
Art. 3º As Gratificações Militares de Segurança Institucional - GMSI, instituídas pela Lei nº 5.007, de 21 de janeiro de 2012, ficam distribuídas pelas unidades da Casa Militar da Governadoria do Distrito Federal conforme Anexo IV deste Decreto.
Art. 4º Ficam exonerados os atuais ocupantes dos cargos de natureza especial, dos cargos em comissão e dos cargos remunerados com Gratificação Militar de Segurança Institucional listados no Anexo III do Decreto nº 36.842, de 26 de outubro de 2015.
Art. 5º Fica mantido o atual ocupante do Cargo de Natureza Política, Símbolo CNP-03, de Chefe da Casa Militar da Governadoria do Distrito Federal.
Art. 6º O saldo financeiro da transformação de cargos remanescente deste Decreto, passa a compor o Banco de Cargos administrado pela Secretaria de Estado de Planejamento, Orçamento e Gestão do Distrito Federal.
Art. 7º O artigo 12 do Decreto nº 36.236, de 1º de janeiro de 2015, passa a vigorar com as seguintes alterações:
"Art. 12. A Casa Militar da Governadoria do Distrito Federal, com status de Secretaria de Estado, é órgão de segurança institucional do Governador, tendo, de forma específica, as seguintes competências: (NR)
I - a segurança pessoal do Governador, de seus familiares e de autoridades eventualmente designadas; (NR)
II - o assessoramento do Governador nos assuntos institucionais relativos às corporações militares do Distrito Federal e às atividades de caráter representativo junto às demais organizações militares; (NR)
III - o suporte ao desenvolvimento e à execução das atividades colaborativas e representativas do cônjuge do Governador do Distrito Federal; (NR)
IV - a segurança da informação e da comunicação no âmbito da Governadoria; (NR)
V - a habilitação e o credenciamento dos órgãos e das entidades da Administração direta e indireta do Poder Executivo do Distrito Federal para o tratamento da informação classificada; (NR)
VI - o assessoramento do Governador na Inteligência de Estado; (NR)
VII - o suporte no desenvolvimento de projetos que envolvam a segurança da informação e da comunicação, a atividade de inteligência e a segurança orgânica de órgãos e entidades designados; (ACRESCIDO)
VIII - o provimento da logística e da segurança orgânica do Palácio do Buriti, da Residência Oficial de Águas Claras e de unidades afins designadas; (ACRESCIDO)
IX - a administração da frota de veículos terrestres e aéreos colocados à disposição da Governadoria; (ACRESCIDO)
X - a ajudância de ordens do Governador; (ACRESCIDO)
XI - o planejamento, no âmbito do Distrito Federal, das atividades relacionadas à ordem pública e social, a serem coordenadas e executadas pelos órgãos competentes. (ACRESCIDO)
§ 1º Integram a estrutura da Casa Militar: (NR)
II - Assessoria de Comunicação; (NR)
III - Subchefia de Assuntos Institucionais; (NR)
IV - Assessoria de Gestão da Estratégia e de Projetos; (NR)
V - Assessoria de Inteligência; (NR)
VI - Subchefia de Gestão Administrativa; (ACRESCIDO)
VII - Subchefia de Operações de Segurança; (ACRESCIDO)
VIII - Subchefia de Segurança da Informação e Comunicação; (ACRESCIDO)
IX - Subchefia Especial da Ordem Pública e Social; (ACRESCIDO)
§ 2º O Chefe Adjunto e os Subchefes da Casa Militar possuem status e ocuparão cargos correspondentes, respectivamente, ao de Secretário Adjunto e ao de Subsecretário. (NR)
§ 3º Os locais onde o Governador trabalha, reside, esteja ou haja a iminência de vir a estar e as suas adjacências são áreas consideradas de segurança da referida autoridade, cabendo à Casa Militar adotar as medidas necessárias à sua proteção, bem como solicitar o apoio operacional de outros órgãos de segurança." Art. 8º Este Decreto entra em vigor na data de sua publicação.
Art. 9º Revogam-se o Decreto nº 36.270, de 14 de janeiro de 2015 e o Decreto nº 36.842, de 26 de outubro de 2015.
